3. Now that you know the zone of your property, determine if you can apply to rezone to allow a secondary suite.
What is the process to apply for a secondary suite? First follow the steps above and find out from the zoning bylaw if you can make an application and what the restrictions are.
Important Note: In the case of creating a suite in an existing building or attempting to legalize an existing suite, it is suggested that you obtain the services of an architect of building designer to determine what will be required to bring a proposed suite or an existing suite into compliance with the building code. Ensure that they are aware that the suite is located in the Central Okanagan. It is highly advisable that you do this prior to rezoning to determine if the project is viable for you.
You will then need to undertake the process to get permission for your secondary suite, this process includes these steps:
Submit a rezoning application. A rezoning application with information on fees and application requirements can be obtained from the Planning Department. The purpose of the application is to determine if you will be permitted a secondary suite.
Obtain a building permit. If your rezoning application is successful and you obtain permission for a secondary suite you will then need to obtain a building permit so that you can ensure that your suite meets with requirements.

Guide to Secondary Suites
What is a zoning bylaw?The Central Okanagan has developed a zoning by law in accordance with the Local Government Act of the Province of British Columbia. The zoning bylaw is a set of maps and a text document that divides an area into zones and sets out regulations for each zone.
Can I have a secondary suite? You can submit a rezoning application in certain zones to request a secondary suite. To see if you can apply to rezone for a secondary suite you need to;
1. Check the General Regulations (Part 3 of the zoning bylaw) for any items that may apply to what you are thinking of doing. Secondary Suite is listed in the index of the zoning bylaw under General Regulations. At the beginning of the regulations regarding secondary suites is a list of zones that can be considered for rezoning to permit a secondary suite. A copy of the specific section pertaining to secondary suites is attached to this
